  • Síðla árs 2010 var lögð fram þingsályktunartillaga á Alþingi um að heimila staðgöngumæðrun í velgjörðarskyni hér á landi. Á svipuðum tíma kom upp mál íslenskra hjóna sem nýttu sér aðstoð staðgöngumóður á Indlandi sem ól þeim dreng um miðjan nóvember. Þegar foreldrar drengsins ætluðu að koma með hann til landsins tók við diplómatísk deila milli Íslands og Indlands þar sem löggjafir landanna samrýmdust ekki og deilt var um forsjá drengsins. Upphófst mikil umræða um málefni staðgöngumæðra hér á landi og virtist sem allir hefðu sínar skoðanir á málefninu.
    Markmið ritgerðarinnar er að varpa ljósi á hinar ýmsu hliðar staðgöngumæðrunar út frá lagalegum sjónarmiðum ásamt því að leita svara við því hvernig löggjöf á sviði tæknifrjóvgunar hefur þróast og hvort karlmenn standi almennt jafnfætis konum í baráttu sinni gegn barnleysi og hvert sú þróun stefnir í komandi framtíð.
    Fjallað verður um lausnir fólks í baráttu sinni gegn barnleysi og sérstök áhersla lögð á staðgöngumæðrun sem eina þessara lausna. Skoðað verður hvernig íslensk löggjöf samrýmist álitamálum tengdum staðgöngumæðrun og hvernig réttindi foreldra, barna og staðgöngumæðra eru tryggð í íslensku löggjöfinni ásamt því að kanna löggjöf annarra ríkja.
    Árið 1996 voru sett lög um tæknifrjóvganir og hefur löggjöfinni verið breytt fimm sinnum frá gildistöku. Í upphafi voru sett mjög ströng skilyrði fyrir því að gangast undir tæknifrjóvgunarmeðferð en mikið vatn hefur runnið til sjávar síðan þá og nú 15 árum síðar hafa skilyrðin breyst töluvert og er löggjöfin nú öllu opnari. Í samræmi við þróun tæknifrjóvgunarlaganna má telja eðilegt að næsta skref verði að heimila staðgöngumæðrun í velgjörðarskyni til þess að jafna hlut þeirra kvenna sem ekki geta nýtt sér núverandi þjónustu vegna líffræðilegra takmarkana. Ef tekið er mið af þróun löggjafar sviði tæknifrjóvgana má ætla að sett verði ströng skilyrði í upphafi þannig að mjög takmarkaður hópur geti nýtt sér úrræði staðgöngumæðra. Með tíð og tíma má ætla að skilyrði staðgöngumæðrunar verði víkkuð þannig að fleiri hópar geti nýtt sér úrræðið og ekki líði á löngu þar til samkynhneigðir karlmenn muni krefjast þess að fá að nota staðgöngumæðrun í baráttu sinni gegn barnleysi. Eftir að búið verði að heimila staðgöngumæðrun í velgjörðarskyni má ætla að staðgöngumæðrun í hagnaðarskyni verði heimiluð í komandi framtíð sem eðlileg þróun á löggjöfinni. Ef staðgöngumæðrun verður heimiluð hér á landi þarf að endurskoða og aðlaga mörg ákvæði ýmissa lagabálka til þess að gæta að réttarstöðu allra aðila sem að málinu koma.
    Ef stjórnvöld myndu auðvelda aðilum ættleiðingarferlið í stað þess að leggja áherslu á staðgöngumæðrun myndi ríkið tryggja fleiri börnum réttindi til lífs og þroska og draga þar með úr fjölda munaðarlausra barna í heiminum.

    Late in the year 2010, a Parliamentary Resolution was put forth at the Althingi in Iceland on permitting “altruistic surrogacy” in Iceland. Around the same time, a case came up where an Icelandic couple took advantage of the assistance of a surrogate mother in India who brought their boy into the world in mid-November. When the Icelandic parents of the boy wanted to bring him to the country, a diplomatic conflict arose between the Icelandic- and Indian governments; the laws of the two countries did not agree with each other and the governments were divided on who had custody of the boy. An important discussion focused on surrogate mothers arose in Iceland after this event, and everyone seemed to have an opinion on the issue.
    The goal of this thesis is to shed a light on the various sides of surrogacy from a legal point of view, along with finding answers to how legislation, in the field of in vitro fertilization, has evolved. It will also raise and answer the question on whether males stand equal to women in their battle towards having children and how their battle will evolve in the near future.
    Solutions for individuals trying to have children will be discussed, with a focus on surrogacy as a solution to this problem. Furthermore, the topics of whether Icelandic legislation goes hand in hand with the voice of the people, how the rights of the parents, child and the surrogate mother are insured in Icelandic laws, and how surrogate laws are elsewhere will be investigated.
    In the year 1996, legislation was passed on in vitro fertilization and those laws have been changed five times since its entry into force. In the beginning, very strict conditions were put forth regarding in vitro fertilization, however, the idea regarding in vitro fertilization has evolved since then. Now, 15 years later, the conditions have changed a great deal and the legislation is much more open. In line with the evolution of in vitro fertilization, one could normally perceive that the next step would be to permit surrogate mothers who take part in altruistic surrogacy in order to balance the percentage of women that cannot use the current service being offered, because of biological limitations. If the evolution of legislation in the field of in vitro fertilization is reflected upon, one can assume that there would be strict conditions in the beginning, allowing only a limited number of people to use surrogate mothers. With time, one can also assume that the conditions would become less strict so that more people could choose this option and that it would not be long until homosexual males could demand that they be allowed to use a surrogate mother in their battle to have children. After permitting altruistic surrogacy, one can assume that commercial surrogacy would be permitted in the near future as an evolution of the events. If the use of surrogate mothers would be permitted in Iceland, several laws would have to be amended to ensure the rights of all the parties taking part.
    If governments would make the adoption process simpler instead of placing their attention on surrogate mothers, the State would insure the rights of more children, their right to life and development, and lower the number of orphans in the world, instead of focusing on surrogate mothers, which will in all likeliness cause the demand for adoption to decrease.
