Upphafi gildandi stjórnarskrár Íslands eru gerð skil og mikilvægir áhrifaþættir nefndir, sem vekja spurningar um stöðu Íslands sem fullvalda þjóðar, sem byggir á lýðræði og þingbundinni stjórn. Beinum valdheimildum forseta Íslands er lýst og sérstaklega er fjallað um synjunarvald forseta Íslands, sem 26. gr. stjórnarskrár Íslands innifelur. Sú grein hefur vakið deilur um hvort sú grein sé táknræn eða virk sem mikilvægur varnagli í stjórnskipun Íslands. Víða var leitað fanga í til þess að rekja þá helstu þætti sem tengja stjórnarskrá við lýðræði og fullveldi, tilgang embættis forseta Íslands og loks eru helstu valdheimildir forseta Íslands greindar í gildandi stjórnarskrá Íslands, sem og tillögum Stjórnlagaráðs að nýrri stjórnarskrá Íslands, sem unnar voru árið 2011. Fjallað er um stjórnarskrá sem sjálfstætt plagg, samfélagssáttmála fullvalda ríkis. Einnig eru raktir þeir þættir sem skilgreina stjórnarskrá sem málamiðlun á milli valdhafa og almennings í sögulegu samhengi. Áhersla er lög á umfjöllun um aðgreiningu valdþátta ríkisins; löggjafavald, framkvæmdarvald og dómsvald, sem lið í því að hámarkar aðhald og öryggisventla í stjórnkerfinu. Í síðari hluta ritgerðarinnar er mikilvægi orðræðu, röksemdafærslu og upplýstri umræðu gerð skil í tengslum við vandaða vinnslu við innihald og gerð stjórnarskráa. Að lokum eru valdheimildir forseta Íslands í gildandi stjórnarskrá og tillögum Stjórnlagaráðs greindar og samanburður gerður á þeim, þar sem í ljós kemur mikill munur á hlutfalli og vægi valdheimilda forseta Íslands. Gildandi stjórnarskrá Íslands er samin og samþykkt af formlegum valdhöfum en sú síðari af almenningi, sem skýrir að einhverju leyti þennan mun á áherslum á embætti og valdheimildir forseta Íslands í því sambandi, eins og rakið er í ritgerðinni. Over the past decades people in Iceland have debated over the authority of the president of Iceland in the constitution. His authority with the ability to object laws from the Congress has been seen as symbolic, until Mr. Ólafur Ragnar Grímsson, president of Iceland from 1996- 2016, executed his power to object laws from the Congress in his last years as president. Articles in the constitution regarding the President’s power are important in order to extend the official power of the people, over the institutions of Government, through the President of Iceland, which serves as their servant as the result of democratic elections. The constitution of Iceland is also important as a framework for the separate institutions of power. In this essay the nature and aim of constitutions in general is explained. The origin of the Icelandic constitution is also explained along with some decisive elements of its production process, which raises questions regarding the state of Iceland as a sovereign nation, based on democracy and Congressional authority. A constitution is not a standardized social contract, copied from one country to another, but rather a framework serving the most demanding social interests of society at any given time and a compromise between the ruling power and the general public. It can describe the separation of institutional powers in order to maximize the internal and effective tools to prevent corruption. The creative process of forming a constitution also calls on the public to participate in social matters related to this process, adding with their knowledge the strength to lay a solid foundation for society’s institutions.
