<dim:field mdschema="dc" element="description" qualifier="abstract" lang="is">Meginmarkmið ritgerðarinnar er að kanna mörkin milli lögmætrar og refsiverðrar háttsemi í íþróttum, með sérstakri áherslu á þær aðstæður þar sem þátttakandi veldur öðrum líkamstjóni. Í þessari umfjöllun er greint frá því hvernig íslensk refsilöggjöf, einkum ákvæði 217., 1. mgr., 218. og 219. gr. almennra hegningarlaga nr. 19/1940, getur átt við í íþróttalegu samhengi. Þrátt fyrir að leikmenn gangist undir samþykkta áhættu með þátttöku sinni er sú áhætta ekki skilyrðislaus. Í ritgerðinni er greint á milli ásetnings og gáleysis og sérstaklega litið til þess hvenær hegðun þátttakanda fer út fyrir eðlilegan ramma viðkomandi íþróttar og verður þar af leiðandi refsinæm. Sérstaklega er litið til þriggja keppnisíþrótta, þ.e. íshokkí, knattspyrnu og körfuknattleiks. Þessar íþróttagreinar hafa mismunandi reglur, átök milli leikmanna og hefðir, sem hafa áhrif á mat á því hvað telst eðlileg áhætta og hvenær hegðun verður ófyrirsjáanleg eða óásættanleg. Niðurstöður ritgerðarinnar benda til þess að þátttakendur í íþróttum samþykki með þátttöku sinni ákveðna almenna áhættu á meiðslum sem fylgir eðlilegum leik. Dómstólar meti ábyrgð íþróttamanna út frá heildstæðu mati á aðstæðum, þ.e. hvort háttsemin beindist persónulega gagnvart brotaþola, hversu alvarleg meiðslin af völdum háttseminnar voru og hvort háttsemin var í eðlilegum tilgangi leiksins.</dim:field>
<dim:field mdschema="dc" element="description" qualifier="abstract" lang="en">The main object of this thesis is to examine the boundary between lawful and criminal conduct in sports, with particular emphasis on situations where a participant causes bodily harm to another. The analysis focuses on how Icelandic criminal law, particularly articles 217, 218(1) and 219 of the General Penal Code No. 19/1940, may apply within the context of sport. Although athletes consent to a certain level of risk by participating, that consent does not extend to all conduct and the assumption of risk is not unconditional. The thesis distinguishes between intent and negligence and specifically considers when a participant‘s behavior goes beyond the normal framework of the sport in question and therefore becomes punishable. Special attention is paid to three contact sports, ice hockey, football and basketball. These sports have varying rules, levels of physical contact and traditions, which influence the assessment of what constitutes acceptable risk and when behavior becomes unforeseeable or unacceptable. The findings suggest the participants in sports accept a general risk of injury inherent in normal play. However, courts assess the liability of athletes through holistic evaluation of the circumstances, including whether the conduct was personally directed at the victim, the severity of the resulting harm and whether the act served a legitimate purpose within the sport.</dim:field>
